 Originally the German Government wanted to ban about 40 breeds.

Following the defeat in the Hamburg Court this was reduced to 4. Now the full text of 

the recently passed German legislation lists just 3 breeds; the Pitbull, 

Amstaff - and Staffordshire Bull Terrier. We just cannot understand why the 

German authorities continually refuse to consider the evidence presented by 

every major animal welfare and veterinary body in the UK.

 Chris Porter advises me that they have taken legal advice today. The solicitor has

recommended that as many letters as possible be sent to the European

Commissioner, Mr David Byrne (see below) pointing out the basic illegalities of the 

German law BEFORE it passes to the upper parliamentary chamber ON 21st DECEMBER.
 The main points contained in the legislation are:


1) That Staffordshire Bull Terriers are listed despite the evidence from the UK

and even Germany that this breed does not represent a threat to the German

public. We have letters from the UK Home Office and the French Ministry of

Agriculture stating that they do not regard this breed as "dangerous".

2) The new German law allows the police to enter premises where they suspect

there is a "dangerous" dog WITHOUT A SEARCH WARRANT.

Mr Byrne has already indicated that the member countries have the legal right to

protect their citizens but he did add - "Indeed, although Article 28 stipulates that Members States may not 

adopt national measures that create restrictions on the free movement of animals

concerned, Article 30 authorises them to do so if such measures are justified on

grounds of the protection of the health and life of humans, provided that the

restrictions concerned are proportionate to the objective to be attained and are

applicable without distinction."

Our argument must be that the German proposals are NOT proportionate and in
practice represent a clear attempt to legislate against this British breed.

Please try to put the case in your own words but (sorry to be obvious 

but) be polite . .... . but please e-mail as soon as possible in the hope that 

Mr Byrne may decide to check with the German Government and perhaps encourage 

them to at least to consider the mass of evidence in defence of our breed.
